Terms for using Rayista.

1. Agreement and scope

These Terms of Use govern your access to Rayista for iPhone, its App Store distribution, the Rayista Pro subscription, the Rayista website, updates, and related support material. Rayista is developed and published by Viacheslav Shkliarov, referred to here as "we", "us", or "our".

By downloading, installing, subscribing to, accessing, or using Rayista, you agree to these Terms. If you do not agree, do not use Rayista.

The Privacy Policy explains how Rayista handles information and forms part of these Terms where applicable.

2. What Rayista does

Rayista previews looks live in the camera and captures photos and videos. Studio lets you adjust photos and videos, create custom looks, and use those looks in the camera. Rayista also supports importing and sharing look files and optional iCloud sync of saved looks.

Features and availability depend on your device, iOS version, permissions, and app version. Captures and supported Studio adjustments are saved in Photos. Deleting an asset in Rayista requests deletion from Photos. Keep backups of important files; iCloud sync can also sync changes and deletions.

3. License to use Rayista

Subject to these Terms, applicable App Store terms, and payment where required, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use Rayista on devices you own or control.

You may not, except where applicable law expressly permits:

• copy, modify, translate, adapt, or create derivative works from Rayista;
• reverse engineer Rayista or try to recreate its source code or rendering pipeline;
• rent, lease, resell, sublicense, redistribute, or commercially exploit Rayista;
• remove copyright, trademark, license, or attribution notices;
• bypass App Store, subscription, security, or access controls; or
• use Rayista to violate law or another person's rights.

These restrictions apply to the app and our materials. They do not prevent you from using its intended adjustment tools, making your own looks, or sharing content you have the right to share.

4. Apple terms

Rayista is distributed through the App Store and is also subject to Apple's rules and the Apple Media Services Terms and Conditions, including the Apple Standard End User License Agreement except where these Terms apply as the custom end-user license agreement presented through the App Store.

Apple provides the App Store and platform services. We are responsible for Rayista itself, subject to the allocation of responsibility in Apple's applicable terms.

5. Free use and Rayista Pro

Rayista is free to download. Every bundled look can be previewed live without paying. Capture with 9 free filters, or use Original without a filter. You can try Studio adjustments for free. Saving Studio edits and custom looks requires Rayista Pro.

Rayista Pro is an auto-renewable subscription that unlocks capture with Pro looks and saving Studio edits and custom looks. It includes new Pro looks released while the subscription is active. Monthly and yearly plans provide the same access.

New Pro looks are included in the existing subscription. A Pro label does not mean a separate purchase. Ending a subscription does not transfer ownership of your photos, videos, or custom content to us.

6. Billing, renewal, cancellation, and refunds

Payment is charged to your Apple Account at confirmation of purchase. The subscription renews automatically at the then-current price for the same period unless it is canceled at least 24 hours before the end of the current period. Apple charges the renewal within 24 hours before the period ends.

You can manage or cancel the subscription in the App Store subscription settings of your Apple Account. Canceling stops future renewals; access continues until the end of the paid period. Uninstalling the app does not cancel a subscription.

Prices, taxes, and any introductory terms are shown by Apple before you confirm and can change for future periods. Refund requests and payment disputes are handled by Apple through Report a Problem. Eligibility varies by country or region.

You can use Restore Purchases in Rayista to restore an active subscription on a device signed in to the same Apple Account. If Apple refunds, revokes, or removes the entitlement, Rayista may stop recognizing it. Nothing here limits mandatory consumer rights.

7. Your content

You retain your rights in the photos, videos, and original content you create or import. We do not claim ownership of your media or custom looks. You may use your own captures and edited media for personal or commercial purposes, subject to any rights in the source material.

You are responsible for having permission to capture, import, adjust, use, or share your content. This includes photographs, recordings, LUTs, preview images, and looks from other people. Camera use may be restricted where you are.

Sharing a look can include a preview image, an author name, and embedded LUT data. Recipients can keep, modify, and share the file again. Share only material you are entitled to distribute. Imported content remains subject to any applicable license from its owner.

8. Acceptable use and safety

Use Rayista only for lawful purposes. Do not use it to record or share content that violates law, privacy rights, publicity rights, intellectual-property rights, confidentiality duties, or another agreement that applies to you.

Do not use the camera in a way that is unsafe. Pay attention to your surroundings while shooting, and never operate the app while driving or in any situation that requires your full attention.

9. Third-party services and components

Rayista relies on Apple platform services. Their terms and privacy policies apply when you use them. References to devices, operating systems, products, services, and trademarks do not imply sponsorship or endorsement by their owners.

Optional iCloud Looks sync uses your iCloud Drive and is subject to Apple's terms, account availability, and storage limits. Turning sync off does not erase existing cloud copies. Photos and any service you choose for sharing have their own storage, deletion, and privacy rules.

10. Ownership

Rayista software, its bundled look collection, website design, text, and graphics are owned by or licensed to us. These rights do not give us ownership of your content. Creating, adjusting, importing, exporting, and sharing looks through the app are permitted uses, subject to rights in any third-party material.

Sending material to support gives us permission to use it to respond to your request, investigate the issue, and fix related faults. It does not give us permission to publish your files in marketing.

11. Updates and availability

We may add, change, suspend, or discontinue looks, features, formats, pricing, compatibility, downloads, or support. We may release updates needed for security, compatibility, or correct operation. Older versions may stop working or may require an update.

We do not promise that Rayista, the App Store, or every service Rayista depends on will always be available. Individual looks may change or be retired in a future version.

12. Warranties

To the maximum extent permitted by law, Rayista is provided "as is" and "as available". We do not guarantee uninterrupted or error-free operation, capture success, rendering accuracy on every device, color fidelity, data preservation, availability, compatibility, or fitness for a particular purpose.

This section does not exclude warranties or remedies that applicable consumer law does not allow us to exclude.

13. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence where applicable.

To the maximum extent permitted by law, we are not responsible for losses that were not reasonably foreseeable, indirect or consequential losses, loss of profit or opportunity, lost or corrupted photos and videos, missed shots, App Store transaction issues, or failures caused by devices, storage, operating systems, or third-party services.

You remain entitled to any mandatory remedies available under the law that applies to you.

14. Suspension and termination

You may stop using Rayista at any time and uninstall it. We may suspend downloads, support, or access where reasonably necessary for security, legal compliance, misuse prevention, payment disputes, or discontinuation.

The license ends if you materially breach these Terms. Provisions that by their nature should survive termination, including ownership, payment obligations, disclaimers, liability, and applicable law, continue to apply.

15. Changes to these Terms

We may update these Terms to reflect changes to Rayista, its distribution, service providers, law, or business requirements. The current version and effective date will remain available at this URL. Where a change materially affects existing users, we will provide notice where reasonably required.

16. Applicable law

These Terms are governed by the laws applicable where the Rayista publisher is established, without depriving consumers of mandatory protections or access to courts available under the law of their country of residence.
